These Terms of Service ("Terms") govern your access to and use of the OPTIC platform and the ommacyber.com website (the "Service"), operated by OMMA Cyber LLC ("OMMA Cyber," "we," "us"). By using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.
OPTIC is pre-release software that analyzes gym programming. It is under active development, may change or be discontinued, and is provided on an "as is" and "as available" basis. You should not rely on it as your sole system of record, and you should keep your own copies of your data.
You are responsible for the accuracy of your account information and for safeguarding your login credentials and any activity that occurs under your account.
You agree not to use the Service unlawfully; upload content you do not have the rights to use; attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or use the Service to build a competing product. You will only upload competition or third-party data that you are permitted to use.
You retain ownership of the programming and other content you provide ("Your Content"). You grant OMMA Cyber a non-exclusive license to host, process, and use Your Content to operate, provide, and improve the Service. You represent that you have the rights and permissions necessary to upload Your Content, including any data relating to your members or athletes. Our handling of personal data is described in our Privacy Policy.
If you send us suggestions or feedback about the Service, you grant us a perpetual, royalty-free license to use that feedback for any purpose without restriction or obligation.
OMMA Cyber owns the Service and all related software, models, and materials, including any improvements. These Terms do not transfer any of our intellectual property to you, except for the limited right to use the Service as described here.
OMMA Cyber and OPTIC are independent and are not affiliated with, endorsed by, or sponsored by CrossFit, LLC, HYROX, Wodify, SugarWOD, or any other platform or organization referenced in the Service. CrossFit® and CrossFit Games® are registered trademarks of CrossFit, LLC; all other product names and marks are the property of their respective owners. References to these names are for identification and compatibility only.
The Service is free to use during the beta period. Any future paid plans will be governed by separate pricing and terms communicated to you in advance.
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any analysis it produces will be accurate or complete.
To the maximum extent permitted by law, OMMA Cyber will not be liable for any indirect, incidental, special, or consequential damages, and our total liability arising out of or relating to these Terms or the Service will not exceed US $100.
You may stop using the Service at any time. We may suspend or terminate access at any time, including when the beta ends or if you breach these Terms. Provisions that by their nature should survive termination — including Sections 5 through 11 and 13 — will survive.
These Terms are governed by the laws of the State of [State], without regard to its conflict-of-laws rules, and any disputes will be resolved in the courts located in [venue].
We may update these Terms from time to time. The updated version will be posted here with a revised date, and your continued use of the Service after changes take effect means you accept the updated Terms.
